Terms and Conditions

I. General Provisions

  1. These General Terms and Conditions (hereinafter the “Terms”) govern the mutual rights and obligations arising in connection with a purchase contract concluded through the BICI Store online shop between:

Ing. Michal Martinek
Company ID (IČO): 11186615
VAT ID (DIČ): CZ6507251542
registered office: Ostružnická 336/28, 779 00 Olomouc, Czech Republic
phone: +420 608 50 99 99
e-mail: info@bicistore.eu

(hereinafter the “Seller”)

and the buyer (hereinafter the “Buyer”).

  1. The online shop is operated at www.bicistore.eu.

  2. The Buyer may be a consumer or an entrepreneur.

  3. A consumer is a person who, outside the scope of their business activity or the independent exercise of their profession, enters into a contract with the Seller or otherwise deals with the Seller.

  4. An entrepreneur is in particular a person who enters into a contract in connection with their business activity or the independent exercise of their profession. Stating a Company ID (IČO) in the order is one of the circumstances indicating that the Buyer is acting as an entrepreneur, but it is not in itself the only decisive criterion.

  5. Provisions of these Terms identified as consumer rights apply only to a Buyer who is a consumer.

  6. The legal relationships between the Seller and the Buyer are governed by the laws of the Czech Republic, in particular Act No. 89/2012 Coll., the Civil Code, and, in the case of a consumer, also Act No. 634/1992 Coll., on Consumer Protection.

  7. The Buyer has the opportunity to read these Terms before submitting an order. For any particular contract, the version of the Terms in effect at the time the purchase contract is concluded shall apply.

II. Product Information and Prices

  1. Information about the goods, their main features, design and price is given for each product in the online shop.

  2. All prices of goods intended for consumers include VAT and all mandatory taxes and fees, unless expressly stated otherwise for a particular offer.

  3. Delivery of ordered goods within the territory of the Czech Republic is free of charge, unless a particular exceptional delivery method is expressly stated otherwise before the contract is concluded.

  4. Any promotional prices apply for the period stated with the offer or while stocks last.

  5. The Seller is not obliged to deliver goods at an obviously incorrect price resulting from a technical or administrative error if, taking all the circumstances into account, it was or must have been obvious to the Buyer that it was an error. The Seller will inform the Buyer of any such error without undue delay.

III. Orders and Conclusion of the Purchase Contract

  1. The Buyer places an order through the online shop.

  2. Before submitting the order, the Buyer has the opportunity to check and correct all the data entered, in particular the selected goods, their quantity, billing and delivery details, delivery method and payment method.

  3. The Buyer submits the order by means of a button or similar control whose label clearly shows that the order creates an obligation to pay.

  4. By submitting the order, the Buyer makes a binding offer to conclude a purchase contract.

  5. The Seller will promptly confirm receipt of the order electronically.

  6. The purchase contract is concluded at the moment the Seller sends the Buyer confirmation that the order has been accepted for processing, from which it is clear that the Seller accepts the order. An automatic message that merely confirms the technical delivery of the order and is labelled as such does not in itself have to constitute acceptance of the order.

  7. The order confirmation contains a summary of the order and is sent to the e-mail address provided by the Buyer.

  8. The purchase contract is concluded in the Czech language.

  9. The concluded contract is archived by the Seller in electronic form. The Buyer will receive information about the concluded contract and the text of the Terms in text form, in particular by e-mail.

  10. The Buyer is responsible for the accuracy of the data provided in the order.

IV. Payment Terms

  1. The purchase price can be paid by the methods offered in the online shop, in particular:

  • by payment card,

  • by bank transfer in advance,

  • where available, by QR payment,

  • in cash upon personal collection agreed in advance.

  1. For goods made or modified to the Buyer’s individual requirements, the Seller may require payment of the full purchase price before production or modification begins.

  2. The Seller will issue the Buyer a tax document in accordance with applicable legislation.

V. Delivery of Goods

  1. The delivery time is stated for the particular goods.

  2. The label “In stock” means that the goods are with the Seller and ready for dispatch. The Seller generally aims to dispatch in-stock orders received on a business day by 10:00 on the following business day; however, this is not a guaranteed delivery time unless expressly stated.

  3. The label “On request” means that the delivery date depends on the availability or production of the particular goods. For individually made or configured goods, the delivery time may generally be 4 to 8 weeks, unless agreed otherwise.

  4. The label “On order” means that the Seller is expecting the goods to be restocked. The indicative lead time may be up to 8 weeks; the Seller will provide more precise information on request.

  5. If no delivery time has been agreed, the goods will be delivered to the consumer without undue delay, and no later than within the period set by law.

  6. Personal collection in Olomouc is possible only by prior arrangement. The Seller does not operate a regular retail store.

  7. When a shipment is delivered, the Seller recommends that the Buyer check in particular the condition of the packaging and any visible damage to the shipment and, if there is damage, have it recorded with the carrier where possible.

  8. Failure to inspect the shipment on receipt, or the absence of a damage report with the carrier, does not deprive the consumer of their statutory rights arising from defective performance.

VI. Consumer’s Right to Withdraw from the Contract within 14 Days

  1. For a contract concluded through the online shop, the consumer has the right to withdraw from the contract within 14 days without giving any reason.

  2. For a purchase contract for goods, the period generally runs from the day on which the consumer, or a third party designated by the consumer other than the carrier, takes delivery of the goods.

  3. If several items of goods are delivered separately within one order, the period runs from the day the last item is received. For goods consisting of several parts, it runs from receipt of the last part.

  4. To meet the deadline, it is sufficient for the consumer to send the notice of withdrawal to the Seller before the 14-day period expires.

  5. The consumer may withdraw by any unambiguous statement, in particular by e-mail to info@bicistore.eu or by using the model form in the annex to these Terms.

  6. The consumer is not obliged to give a reason for withdrawal.

  7. The consumer shall send or hand over the goods to the Seller without undue delay, and no later than 14 days after withdrawing from the contract.

  8. The consumer bears the direct costs of returning the goods to the Seller.

  9. For a bicycle or other bulky goods that, by their nature, cannot be returned by ordinary post, the estimated maximum amount of the direct costs of return is CZK 500.

  1. The goods do not have to be returned in the original packaging. However, the consumer must package the goods suitably for transport.

  2. The consumer is liable only for any diminished value of the goods resulting from handling the goods in a way other than is necessary to become acquainted with their nature, characteristics and functionality.

  3. The Seller will refund to the consumer all money received under the contract without undue delay, and no later than 14 days after withdrawal.

  4. The money will be refunded by the same method by which the Seller received it from the consumer, unless the parties agree otherwise and no additional costs arise for the consumer as a result.

  5. The Seller is not obliged to refund the money before the consumer hands over the goods or proves that they have been sent back, whichever occurs first.

  6. If another item was provided free of charge with the goods as a gift, the gift is agreed subject to a condition subsequent: if the consumer withdraws from the contract, the consumer must return the related gift together with the goods.

VII. Goods Customised to the Consumer’s Requirements

  1. The consumer does not have the right to withdraw from the contract within the 14-day period, among other cases, in the case of delivery of goods:

  • made to their specific requirements, or

  • adapted to their personal needs.

  1. For bicycles, this may mean, for example, genuinely individual production or modification carried out specifically for a particular consumer, such as non-standard paintwork to individual specifications, custom geometry or another modification that the Seller does not normally offer as a standard stock variant.

  2. Merely choosing from predefined standard options, such as commonly offered sizes, colours or component variants, does not in itself automatically mean that the consumer loses the right to withdraw.

  3. If the exception to the right of withdrawal applies to a particular order, the consumer will be informed of this before the contract is concluded.

VIII. Consumer Rights Arising from Defective Performance

  1. The Seller is liable to the consumer for the goods being free from defects upon receipt and, in particular, for the goods:

  • corresponding to the agreed description, type, quantity, quality and other agreed characteristics,

  • being fit for the purpose for which goods of this kind are normally used, or for the purpose agreed with the Buyer,

  • having the usual characteristics that can reasonably be expected given the nature of the goods,

  • being delivered with the accessories and instructions that can reasonably be expected,

  • meeting safety requirements and the requirements of legal regulations.

  1. The Seller is also liable for a defect resulting from incorrect assembly carried out by the Seller or under the Seller’s responsibility.

  2. If the consumer carries out the assembly themselves and the defect results from a deficiency in the assembly instructions provided by the Seller, this too is considered a defect of the goods.

  3. The consumer may give notice of a defect that appears on the goods within two years of receipt.

  4. If a defect appears within one year of receipt, the goods are presumed to have been defective at the time of receipt, unless the nature of the goods or of the defect rules this out.

  5. The period for giving notice of a defect does not run for as long as the consumer cannot use the goods because of a defect that was rightfully notified.

  6. The consumer is not entitled to rights arising from defective performance if they caused the defect themselves.

  7. Normal wear and tear of the goods caused by their ordinary use is not a defect.

IX. Consumer’s Claims in the Case of a Defect

  1. If the goods are defective, the consumer may require the defect to be remedied.

  2. The consumer may, at their choice, require:

  • repair of the goods, or

  • delivery of new goods without defect,

unless the chosen remedy is impossible or disproportionately costly compared with the other.

  1. Proportionality is assessed in particular with regard to the significance of the defect, the value the goods would have without the defect, and whether the defect can be remedied in another way without significant difficulty for the consumer.

  2. The Seller may refuse to remedy the defect if doing so is impossible or disproportionately costly.

  3. The Seller will remedy the defect within a reasonable time after it has been notified and without significant difficulty for the consumer.

  4. The Seller will take delivery of the goods needed to remedy the defect at its own expense.

  5. The consumer may require a reasonable discount on the purchase price or withdraw from the contract in particular if:

  • the Seller has refused to remedy the defect,

  • the Seller has not remedied the defect properly or within a reasonable time,

  • the defect appears repeatedly,

  • the defect is a material breach of the contract, or

  • it is clear from the circumstances that the defect will not be remedied within a reasonable time or without significant difficulty for the consumer.

  1. The consumer cannot withdraw from the contract because of a defect if the defect is insignificant. A defect is presumed not to be insignificant.

  2. The consumer’s rights arising from defective performance cannot be excluded or limited in advance by these Terms.

X. Making and Handling Complaints

  1. A defect can be notified to the Seller from whom the goods were purchased.

  2. The consumer may give advance notice of a complaint in particular:

by e-mail: info@bicistore.eu
by phone: +420 608 50 99 99

Goods intended for assessment of the complaint can, by arrangement, be sent or delivered to the Seller’s registered office address:

Ing. Michal Martinek
Ostružnická 336/28
779 00 Olomouc
Czech Republic

  1. When making a complaint, it is advisable to state:

  • the Buyer’s identification,

  • the order number or other information that identifies the purchase,

  • the identification of the goods complained about,

  • a description of the defect and how it manifests itself,

  • the requested way of resolving the complaint,

  • contact details for informing you of the outcome.

  1. The consumer must prove that they bought the goods from the Seller. However, they are not obliged to prove this solely by the original receipt or invoice; it can also be proven in another credible way.

  2. When a complaint is made, the Seller will give the consumer written confirmation stating in particular the date the complaint was made, its content, the requested way of resolving it and the consumer’s contact details.

  3. The complaint, including the remedying of the defect, must be resolved and the consumer informed of the outcome no later than 30 days from the date it was made, unless the Seller and the consumer agree on a longer period.

  4. If this period passes without result, the consumer may demand a reasonable discount or withdraw from the contract.

  5. After the complaint has been resolved, the Seller will give the consumer confirmation of the date and manner in which it was resolved, including confirmation of any repair carried out and how long it took. If the complaint is rejected, the Seller will provide written reasons.

  6. If the complaint is justified, the consumer is entitled to reimbursement of the costs reasonably incurred in exercising rights arising from defective performance, to the extent laid down by law.

  7. Before sending a bicycle or other bulky goods in for a complaint, the Seller recommends contacting customer support to agree on a suitable method of transport.

XI. Voluntary Quality Guarantee on the Frame – 60 Months

  1. In addition to the statutory rights arising from defective performance, the Seller provides a voluntary quality guarantee of 60 months from receipt of the goods on new bicycle frames and on new frames forming part of a complete bicycle purchased from the Seller.

  2. This guarantee is a contractual right over and above the statutory minimum and does not in any way limit the consumer’s statutory rights arising from defective performance against the Seller.

  3. The provider of this guarantee is:

Ing. Michal Martinek
Company ID (IČO): 11186615
Ostružnická 336/28, 779 00 Olomouc, Czech Republic

  1. The guarantee covers manufacturing and material defects of the frame that appear during the guarantee period.

  2. In the case of a defect covered by this voluntary guarantee, the Seller will, depending on the nature of the defect, arrange for the frame to be repaired free of charge or replaced with a defect-free frame of the same or a comparable type. If the original frame is no longer available, it may be replaced with a technically and qualitatively equivalent frame.

  3. The voluntary guarantee does not cover defects and damage caused in particular by:

  • a fall, accident, impact or other mechanical damage,

  • use of the bike in a way for which the frame was not designed,

  • incorrect assembly, where the Seller is not responsible for it,

  • use of unsuitable or incompatible components,

  • exceeding the specified tightening torques or other technical limits,

  • neglected maintenance,

  • unprofessional structural modification of the frame,

  • drilling, grinding, cutting or other interference with the frame’s structure,

  • another external event unrelated to a manufacturing or material defect.

  1. The above limitations of the voluntary guarantee apply only where there is a causal link between the circumstance in question and the occurrence of the defect.

  2. Normal cosmetic wear, scratches, paint damage caused by use and mechanical damage are not in themselves a manufacturing or material defect of the frame.

  3. A right under the voluntary guarantee can be exercised in the same way as a complaint under Article X of these Terms.

  4. The Buyer must allow the Seller to assess the frame. To identify the purchase, an invoice, an order or another credible proof of purchase from the Seller may be used.

  5. At the latest upon receipt of the goods, the Seller will give the Buyer confirmation of this guarantee in text form. The confirmation may consist of this article of the Terms together with the order confirmation or proof of purchase from which the goods covered by the guarantee can be clearly identified.

  6. If the manufacturer provides an additional or broader guarantee for a particular product, its terms are governed by the declaration of the relevant guarantor.

XII. Use, Assembly and Maintenance of Bicycles

  1. The Buyer is obliged to use the bicycle and its components in accordance with their intended purpose, technical limits and safety instructions.

  2. Detailed assembly instructions, recommended tightening torques, and information on setup, maintenance and safety are provided in a separate manual supplied with the goods or made available by the Seller.

  3. Incorrect assembly or maintenance carried out by the Buyer may lead to damage to the goods. This does not, however, affect the consumer’s rights where the incorrect assembly was caused by a deficiency in the instructions provided by the Seller.

  4. The Seller recommends regular inspection of the bicycle and its safety-critical components, and professional servicing at intervals appropriate to how intensively and in what way the bicycle is used.

XIII. Buyer Who Is an Entrepreneur

  1. If the Buyer enters into the contract in the course of their business activity or the independent exercise of their profession, the provisions of these Terms that give special protection to consumers do not apply, in particular the consumer’s statutory 14-day right to withdraw from a distance contract.

  2. An entrepreneur’s rights arising from defective performance are governed by the general provisions of the Civil Code on the purchase contract and by any special arrangements between the Seller and the Buyer.

  3. This does not affect the voluntary quality guarantee, if by its terms it is also provided to the Buyer concerned.

XIV. Personal Data Protection

  1. The Seller processes the Buyer’s personal data in particular to the extent necessary for concluding and performing the purchase contract, fulfilling legal obligations, handling complaints and protecting the Seller’s legitimate legal claims.

  2. Detailed information on the scope, legal bases and duration of processing, and on the rights of data subjects, is set out in the separate Privacy Policy published in the online shop.

  3. Consent to receive marketing communications, where required, is not a condition for concluding a purchase contract.

XV. Out-of-Court Resolution of Consumer Disputes

  1. If a dispute arises between the Seller and a consumer from a purchase contract and cannot be resolved by mutual agreement, the consumer may submit a proposal for its out-of-court resolution.

  2. The body competent for out-of-court resolution of consumer disputes is:

Czech Trade Inspection Authority (Česká obchodní inspekce)
Central Inspectorate – ADR Department
Gorazdova 1969/24
120 00 Prague 2
Czech Republic
e-mail: adr@coi.gov.cz

Online information is available on the Czech Trade Inspection Authority’s website in the section dedicated to out-of-court resolution of consumer disputes (ADR).

  1. Before starting out-of-court dispute resolution, the Seller recommends that the consumer first contact the Seller at info@bicistore.eu and try to resolve the matter directly.

XVI. Final Provisions

  1. If any provision of these Terms is invalid, ineffective or unenforceable, this does not affect the validity and effectiveness of the other provisions.

  2. The Seller may amend or supplement the Terms. An amendment does not affect rights and obligations that arose while the previous version of the Terms was in effect.

  3. The purchase contract may be amended or terminated only by agreement of the parties or on grounds laid down by law or by the contract.

  4. Disputes are resolved before the courts with subject-matter and territorial jurisdiction under the applicable legislation of the Czech Republic. This does not affect the consumer’s special statutory rights.

  5. These Terms take effect on 24 August 2026.
